ISLAMABAD: Setting aside objections by the registrar’s office, the Supreme Court has admitted for preliminary hearing a petition by the Lahore High Court Bar Association (LHCBA) for review of the July 31, 2009 verdict wherein more than 100 superior courts judges were sent packing.

A three-judge bench headed by Chief Justice Anwar Zaheer Jamali on Friday took up the LHCBA’s appeal against the February 6, 2014 decision of the registrar, in which a petition seeking review of the verdict which declared proclamation of emergency on Nov 3, 2007 as unconstitutional, was returned.

The LHCBA and the judges through a petition had challenged the July 31, 2009 verdict and contended that a number of judges who had taken oath under the PCO after the proclamation of emergency were forced to resign because contempt cases had been initiated against them. They contended that the judgment was biased and breached the provisions of the constitution because several judges were removed without following due process of law.
Ali Zafar, counsel for LHCBA, appeared before the bench and appealed that the registrar’s office while rejecting the petition failed to mention any provision of law or rules. “It is not understandable how registrar can assume the role, authority and function of a court in throwing out the petition on his assumed notions,” stated the appeal. After hearing the arguments, the bench set aside the objections and accepted the petition for preliminary hearing.
