ISLAMABAD: The Supreme Court will indict Sindh Police inspector general (IG) on February 2 for transferring an official to the anti-corruption department in violation of the court’s order.

A three-judge bench of the court, headed by Justice Amir Hani Muslim, on Thursday took up the case of Saifullah Phulpoto’s unlawful transfer to the anti-corruption department. Phulpoto had been inducted into Sindh Police as an ASI in 1995 and rose to the rank of inspector, grade 16. In 2000, he was transferred to the anti-corruption department as an assistant director (grade-17). Over the years, he was promoted to the level of deputy director. In 2013, the court declared Phulpoto’s deputation as void, directing him to return to his parent department, police.

However, after some time, the provincial government once again deputed Phulpoto to the anti-corruption department in violation of the court’s order. Phulpoto had been serving as assistant director in the anti-corruption department in Ghotki until recently. According to his service record, he was dismissed from job four times, but was reinstated later. The bench on December 9 had rejected an unconditional apology by Sindh IGP Ghulam Haider Jamali for transferring the official to the anti-corruption department in violation of the court’s order.

The bench on Wednesday appointed Sindh Additional Advocate General Sarwar Khan as prosecutor in this contempt case. Appearing on behalf of the IG, Shahid Bajwa again submitted an unwritten apology, but the bench rejected it. Justice Hani remarked that it was not a mistake but a deliberate act in violation of the court’s order, adding that the IG had intentionally made a mockery of the court’s order. He also said that the mistake could be rectified within a minute, but this was not done by him.

The bench also asked the IG why he was so “kind” to Phulpoto and whether he is even eligible to remain in service. On the other hand, Phulpoto told the bench that two of his brothers who were in police were killed in an encounter with dacoits, therefore he got the promotions. But Justice Hani asked him whether he should be given a license to indulge in corruption just because his brothers died in the line of duty. Meanwhile, Sindh AAG told the court that the Sindh chief minister is unaware of the case.
